1. Account and Email Requirements
We will establish your account once payment has been processed and verified. Your email will be used for essential communication, including service notices and abuse inquiries. Maintaining accurate contact information is mandatory, and providing false information may result in account suspension or termination.
For high-risk transactions or dedicated server orders, additional verification such as government-issued ID or payment card scans may be required. Non-compliance may result in cancellation of the order.
2. Account Ownership
The owner of the payment method (credit card or PayPal account) used for the transaction is considered the authorized account owner.
3. Dedicated IP Address Policy
Requests for dedicated IP addresses must include sufficient justification, adhering to policies set by the American Registry for Internet Numbers (ARIN). Requests lacking proper justification may be denied.
4. Content and Copyright Compliance
Our services may only be used for legal purposes. You are responsible for ensuring your use of our services does not infringe upon intellectual property rights or violate applicable laws. You agree to indemnify Virteche against claims arising from misuse of our services.
4.1 Digital Millennium Copyright Act (DMCA)
Virteche complies with the DMCA by responding to valid copyright infringement notices. Providing false claims under the DMCA may result in liability.
4.2 Prohibited Content
The following are examples of prohibited content on our VPS and dedicated servers:
Unauthorized or pirated software
IP scanning tools
Hacking or brute-force scripts
Spam and related tools
Illegal or unethical activities
Violations of this policy may result in immediate suspension or termination without prior notice.
5. Payment and Suspension Policies
Payment must be made prior to the start of each billing cycle. Failure to pay on time may result in suspension or termination of services.
6. Anti-Spam Policy
We maintain a zero-tolerance stance on unsolicited email (spam). Any account involved in spam activities will be terminated without notice.
7. Data Backup Responsibility
Virteche is not liable for loss of data. It is your sole responsibility to maintain up-to-date backups of all data stored on our services.
8. Cancellations
Cancellations must be submitted 24 hours before the due date.
9. Resource Usage Guidelines
Resource usage exceeding plan limits may result in service throttling or suspension. Compliance with stated limits is required to maintain service.
10. Indemnification Clause
You agree to defend and indemnify Virteche against any claims or damages resulting from your use of our services.
11. Governing Law & Arbitration
These Terms shall be governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes under these terms will be resolved by binding arbitration in New York in accordance with the rules of the American Arbitration Association.
12. Changes to Terms of Service
We reserve the right to modify these terms at any time. Your continued use of the services after such modifications constitutes your acceptance of those changes.
