1. Overview#
Virteche LLC (“Virteche,” “we,” “us,” or “our”) respects the intellectual-property rights of others and expects the users of our services to do the same. This policy explains how copyright owners can notify us of material they believe infringes their rights, how users can respond, and how we deal with repeat infringers, in accordance with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.
This policy applies across all of our services and the trade names covered by our designated-agent registration: Virteche Cloud, Virteche Global, and Virteche. It supplements our Terms of Service.
Because Virteche both hosts customer content and transmits network traffic on behalf of its customers, this policy and the procedures below are intended to support the safe harbors for both service-provider functions — transitory digital network communications under § 512(a) and hosting/storage at the direction of a user under § 512(c).
2. Designated Agent for Copyright Notices#
Virteche has registered a Designated Agent with the U.S. Copyright Office to receive notifications of claimed infringement. Send all copyright notices and counter-notices to the agent below. Notices sent to any other address may not be received or acted upon.

3. Filing a Notice of Claimed Infringement#
If you are a copyright owner, or authorized to act on behalf of one, and you believe that material available through our services infringes your copyright, you may submit a written notice to our Designated Agent. To be effective under § 512(c)(3), your notice must include substantially all of the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of those works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material — for example, the specific URL, IP address, file path, or server on which it resides.
- Information reasonably sufficient to permit us to contact you, such as your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and — under penalty of perjury — that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Upon receipt of a notice that substantially complies with these requirements, we will act expeditiously to remove or disable access to the identified material and will take reasonable steps to notify the affected user that we have done so.
4. Counter-Notification#
If you are a user whose material has been removed or disabled and you believe the removal was the result of mistake or misidentification, you may submit a counter-notification to our Designated Agent under § 512(g). To be effective, a counter-notification must be a written communication that includes substantially all of the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Virteche may be found), and that you will accept service of process from the person who submitted the original notice or an agent of that person.
If we receive a valid counter-notification, we may forward it to the complaining party and inform them that we may restore the removed material in 10 to 14 business days. Unless the complaining party notifies us that they have filed an action seeking a court order to restrain the allegedly infringing activity, we may restore the material in our discretion.
5. Repeat-Infringer Policy#
In accordance with § 512(i), Virteche has adopted and reasonably implements a policy providing for the termination, in appropriate circumstances, of the accounts of users and account holders who are repeat infringers. We apply this policy consistently across our hosting and network-transmission services so that it supports the safe harbors under both § 512(a) and § 512(c). It works as follows:
- We log every notice. Each copyright notice received at [email protected] is recorded in an internal register, including the date received, the complaining party, the account and material identified, and the action we took.
- We act on valid notices. For each notice that substantially complies with § 512(c)(3), we expeditiously remove or disable access to the identified material and record a strike against the responsible account.
- Strikes accumulate. A strike is not counted, or is reversed, where the user submits a valid counter-notification and the material is restored, or where we determine the notice was defective or the removal was a mistake. Egregious, willful, or large-scale infringement may result in immediate termination without regard to the strike count.
- Termination follows repeat infringement. An account that accumulates three strikes is subject to termination. Termination means closure of the account and suspension or cancellation of the associated services — including any VPS, dedicated server, proxy, or other service — consistent with our Terms of Service.
- We follow through. The register is reviewed so that accounts meeting the repeat-infringer criteria are actually terminated, and terminated users may not circumvent this policy by opening new accounts.
6. Misrepresentations#
Under § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees. Do not make false claims in a notice or counter-notification.
7. Changes to This Policy#
We may update this policy from time to time. When we make material changes, we will update the “Last updated” date at the top of this page. Our Designated Agent registration with the U.S. Copyright Office must be renewed periodically to remain effective; the contact details published here will be kept current with that registration.
8. Contact#
All copyright notices and counter-notices must be directed to the Designated Agent in Section 2. For general questions about this policy, you may also email [email protected].
